Hate to play the devil’s advocate, but that kid can probably get any evidence found on the phone thrown out on 4th ammendment basis. (freedom from illegal search and seizure). He must have been under arrest and probably cause must have been established in order for the phone to be considered evidence.

And the kid(s) are flippin’ idiots. They steal a car and wreck it in 10 minutes flat. Amazing stupidity of the silver spoons.

Definitions of the disaster may be many times the combination of a young driver and a car with hundreds of HP.

I too, question the wisdom of giving a car like that to a teenager.

As for Konraden, “Steal”? Did you read the article? As for your attempt at interpretation of the law, if you are apprehended by the police, they do not necessarily have to place you under arrest to search you. They only have to be able to prove probable cause later. With the damage to the residence, and then leaving the scene, it was pretty obvious to anyone that a crime was committed, and one would assume that an arrest WAS made, anyway.

why blame the parents? the guy driving was already 19…. you don’t blame the parents for buying his son a nice car… i think the teen driver should be punished, no car until he is 30! lol that way he will learn the importance of having your own fck!ng BMW!
